The plenary session of the Supreme Court involved the heads of judicial panels and judges of the Supreme Court, scholars, members of the scientific advisory council, representatives from the General Prosecutor's Office, the ministries of justice, labor and social protection, as well as members of the bar association.
Discussions focused on draft normative resolutions (NR) regarding the resolution of labor disputes, amendments to the NR concerning civil and civil procedural legislation, including in the state language.
Judge Tynyshlyk Moldakhmetova provided clarifications on the pre-trial procedure for resolving labor disputes, the process of concluding, amending, and terminating employment contracts, changes in working conditions, and the expanded role and powers of the conciliation commission.
It was noted that the discovery of an employee being under the influence of alcohol during inter-shift rest cannot serve as grounds for the employer's initiative to terminate the employment contract. Other issues related to law enforcement were also clarified.
According to Supreme Court Judge Galymzhan Myrzake, amendments to 11 NRs on general issues of judicial activity, civil code (CC), and civil procedural code (CPC) have standardized certain terms concerning changes in legislation, specified the requirements for the content of claims, detailed the evidence to be attached to claims, clarified the procedure for determining the size of the authorized capital of LLCs, and explained the procedure for convening and conducting general meetings of shareholders, among other matters.
The Chairman of the Supreme Court's civil cases panel, Nurselik Sharipov, emphasized the importance of quality development of legal documents in the state language, ensuring their ease of use for the effective protection of citizens' rights.
It was highlighted that the clarifications of the NRs would ensure uniformity in judicial practice.
Supreme Court Chairman Aslambek Mergaliyev, noting the constructiveness in the exchange of opinions, emphasized the relevance of the draft NRs.
As a result of the discussions, the participants of the plenary session voted in favor of adopting the normative resolutions, which are available on the Supreme Court's website in the "Legislation" section.
The NRs will be officially published in the Standard Control Bank of normative legal acts of the Republic of Kazakhstan.
