An 18-year-old visitor, who entered the pawn shop to retrieve his phone, thwarted the robbery attempt. The criminal was apprehended at the scene, and the young visitor was awarded a certificate of commendation.
In court, his case was examined under Article 24 Part 3, Article 191 Part 1, Clause 1 of the Criminal Code of the Republic of Kazakhstan (attempted open theft of someone else's property with a threat of violence). Later, the qualifying characteristic of "with a threat of violence" was removed.
The modification of the charges, in the absence of objections from the victim, is mandatory for the court.
The defendant's guilt was substantiated by the testimony of the victim and her representative, video recordings, and other evidence.
Based on the materials presented, the court found the defendant guilty. The crime, categorized under the applicable articles, falls under the medium severity category of offenses.
Mitigating factors recognized include full admission of guilt, sincere remorse, the young age of the defendant, and the absence of prior convictions. No aggravating factors were established.
According to the law, the punishment for attempting a crime cannot exceed ¾ of the maximum term. Given that the investigation was conducted expeditiously, in accordance with Article 56 Part 3 of the Criminal Code, the penalty is limited to ½ of the maximum term.
As a result, the defendant was sentenced to 1 year and 6 months of restricted freedom.
