The discussion involved Supreme Court judges, Majilis Parliament deputy Aigul Kuspan, Chairman of the Republican Bar Association Aydin Bikebaev, Deputy Chairman of the Board of the National Chamber of Entrepreneurs "Atameken" Gulnar Bijanova, as well as representatives from the General Prosecutor's Office, the Ministry of Internal Affairs' Penal Enforcement Committee, and the RK.
Participants noted a trend towards a decrease in the proportion of court-approved requests for the application of arrest. While in 2021, nearly 90% of such requests were granted, this figure dropped to 75% by 2024. At the same time, courts have increasingly turned to alternative preventive measures, such as house arrest and bail. The number of house arrest cases rose from 860 in 2021 to 1911 in 2024, while the use of bail increased from 59 to 214, which is more than fourfold.
Beginning in 2024, a project utilizing electronic bracelets has been actively implemented at the initiative of the Supreme Court. Currently, they are used for 60% of individuals under house arrest, compared to just 3% in 2021. Over the past 10 months, courts have applied 505 bracelets.
Furthermore, roundtable participants discussed relevant aspects of conditional early release and the possibility of replacing the remaining part of the sentence with a milder one. As a result of the meeting, recommendations were developed to improve the practice of applying these legal institutions.
